Benelux trademarks
In the Benelux, trademark rights can be obtained by registration only.
Trademarks applications are filed with the Benelux Trademarks Office (BTMO), which is located in The Hague.
Generally speaking, the registration procedure will take approximately one year, counting from the date of application.
The application procedure entails an examination on absolute grounds as well as a mandatory search for earlier trademarks. It should be noted, however, that the result of the search for prior marks cannot be held against the applicant and is issued for information purposes only.
